The story is

here on the Questionable Authority blog. The NCSE article gives the false impression that the suit is just over the biology textbooks -- textbooks in other subjects have been involved, including textbooks in history and literature. I have discussed the lawsuit in several articles in this blog [

The final
decision appears to be a mix of rulings on the merits and dismissals on technicalities. It will take a while to sort out exactly what happened.
